Photographic Rights Policy
1. PURPOSE
Avondale College is committee to ensuring that the rights of photographers and photographic subjects are preserved. Avondale College also is committed to compliance with the Australian Copyright Act 1968 in relation to photographs.
2. PROCEDURE
It is the responsibility of persons taking photographs on behalf of Avondale College for a fee or for donation, or those taking photographs on any of the campuses of Avondale College for their own commercial purposes, or accepting photographs for college use, to be conversant with the Avondale College policy on photographic rights.
For example :
- a photograph is protected automatically from the moment it is taken
- generally, the owner of a photograph copyright is the photographer, unless the photographer was paid to take the photograph, in which case the owner of the copyright is the organisation who paid the photographer unless there was an agreement to the contrary
- Avondale College may make mutually beneficial arrangements with photographers concerning the ownership of copyright before photographs are taken. If agreements are made about an existing photograph, this agreement should be signed by both parties and be available in writing.
